BORROWED VEHICLE AGREEMENT

This Borrowed Vehicle Agreement (the "Agreement") is entered into by and between Top Gun Hammond, LLC ("Owner") and:

(hereinafter referred to as the "Borrower").

Make/Model: 2012 GMC Acadia

1. Purpose of Agreement

The purpose of this Agreement is to establish terms and conditions for the Borrower’s use of the above-referenced vehicle (the "Vehicle"), ensuring that Top Gun Hammond, LLC is held harmless in the event of any accident, ticket, or fine incurred during the Borrower’s possession of the Vehicle.

2. Term of Use

The Borrower is permitted to use the Vehicle from the date of this Agreement until the return of the Vehicle to Top Gun Hammond, LLC. The Borrower agrees to return the Vehicle in the same condition as received, normal wear and tear excepted.

3. Driver Insurance Requirement

The Borrower hereby certifies that they possess valid and current auto insurance that meets the minimum requirements of the state of Louisiana. The Borrower certifies they have proof of insurance and agree to provide evidence upon request.

4. Hold Harmless Clause

The Borrower agrees to hold Top Gun Hammond, LLC harmless and indemnify it from any and all liability, claims, damages, losses, or expenses (including legal fees) arising out of or in connection with:

• Any accidents or collisions involving the Vehicle;
• Any fines, tickets, or penalties incurred during the Borrower’s use of the Vehicle;
• Any damage to the vehicle or other property.

5. Condition and Use of the Vehicle

The Borrower acknowledges that the Vehicle is being borrowed "as-is" and agrees to inspect the Vehicle prior to use. The Borrower shall not use the Vehicle for any illegal purposes or in a manner inconsistent with applicable laws or regulations.

6. Return of Vehicle

The Borrower agrees to return the Vehicle to Top Gun Hammond, LLC in the condition received, except for normal wear and tear. Crew cars have a maximum use of 1 hour unless otherwise approved, in which case the maximum use is extended to 24 hours, with a limit of 25 miles on the vehicle. Failure to return the Vehicle as agreed or exceeding the specified limits may result in penalties or legal action.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Louisiana.

8. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, whether written or oral, relating to the subject matter herein.

By signing below, the Borrower acknowledges that they have read, understood, and agree to the terms and conditions set forth in this Agreement.
